Acceptable Use Policy
This Acceptable Use Policy (this “Policy”) identifies the persons who may not use the Services, the businesses and activities that 402pay does not support, and the uses of the Services that are prohibited. This Policy applies to every business that uses the Services and to every person acting on its behalf, forms part of the Terms of Service, and must be complied with for so long as the Services are used. Capitalized terms not defined in this Policy have the meanings given in the Terms of Service.
The categories set out below are illustrative and not exhaustive, and 402pay may amend them as laws and risks evolve. Any business that is uncertain whether its activities are permitted should contact legal@402pay.co before accepting Payments.
Restricted persons and jurisdictions
The Services may not be used by any person if that person, its business or any person that owns or controls it:
- (a) is the subject or target of sanctions administered or enforced by the United States, including by the Office of Foreign Assets Control of the U.S. Department of the Treasury, or is owned or controlled by such a person (a “Restricted Person”);
- (b) is located, organized or ordinarily resident in a country or region that is subject to comprehensive U.S. sanctions (a “Restricted Jurisdiction”); or
- (c) would, by using the Services, cause 402pay to breach any U.S. sanctions law.
The Services may not be used to deal with, or for the benefit of, any Restricted Person or any person located in a Restricted Jurisdiction.
Prohibited businesses
The Services may not be used in connection with any unlawful activity, or to operate, promote or accept Payments for:
- (a) controlled substances, illegal drugs, drug paraphernalia, and products intended to imitate them;
- (b) weapons, ammunition, explosives, and their component parts;
- (c) unlicensed financial services, including money transmission, currency exchange, the custody of funds belonging to others, and mixing or tumbling services;
- (d) securities, investment schemes, pyramid or multi-level marketing schemes, and any offering that promises guaranteed returns;
- (e) content that sexually exploits minors or depicts non-consensual acts;
- (f) products or services that involve or facilitate human trafficking or forced labor;
- (g) counterfeit goods, or goods or services that infringe any trademark, copyright, patent or other proprietary right;
- (h) stolen data or credentials, malware, and hacking or account takeover services;
- (i) content or services that promote violence, terrorism or hatred; or
- (j) businesses that engage in deceptive, unfair or abusive practices, including get-rich-quick schemes, fabricated reviews and subscriptions that are unreasonably difficult to cancel.
Prohibited uses
Irrespective of the nature of its business, no person may use, or attempt to use, the Services to:
- (a) violate any applicable law, including any law relating to export controls, anti-money laundering or privacy;
- (b) launder money, finance terrorism or evade sanctions;
- (c) structure payments to avoid reporting obligations, or otherwise conceal the source of funds;
- (d) provide false, manipulated or misleading information regarding the identity, ownership or activities of any person or business;
- (e) deceive any customer, including by means of undisclosed fees or subscriptions that are unreasonably difficult to cancel;
- (f) charge any customer, including an automated agent, for goods, services or requests that are not delivered;
- (g) accept payments on behalf of any other business without the prior written approval of 402pay;
- (h) harass, abuse or harm any person;
- (i) compromise the security of any account, wallet or key, or obtain the credentials of another user;
- (j) circumvent any measure that limits or protects access to the Services, or probe, scan or breach the security of any system or network;
- (k) transmit unsolicited communications, scrape or crawl the Services, or impose an unreasonable load on them;
- (l) decompile or reverse engineer the Services, or access any non-public part of them;
- (m) resell or copy the Services, or use access to them to develop a competing product, without the written permission of 402pay;
- (n) use the name, logo or marks of 402pay other than as permitted by 402pay, or imply any endorsement or affiliation that does not exist; or
- (o) open or operate an account for any person whose access 402pay has suspended or terminated.
Monitoring and enforcement
402pay may review the use of the Services to maintain their safety and lawfulness and will determine, acting reasonably, whether any business or activity violates this Policy. Any violation of this Policy constitutes a breach of the Terms of Service.
Where 402pay reasonably believes that this Policy has been violated, it may restrict, delay or block any payment request, payment method or account, request information, suspend or terminate access to the Services, and report the activity to the competent authorities where required. 402pay may take such action without notice where required by law or by the risk involved, and may be prohibited by law from disclosing the reasons for its decision. Transfers that have been confirmed on a Network cannot be reversed.
Any person who believes that a business is violating this Policy may report it to legal@402pay.co, identifying the payment page or payment request concerned and describing the conduct observed. 402pay reviews the reports it receives and may act on them in accordance with this Policy.
Changes to this policy
402pay may amend this Policy by publishing an updated version and will notify affected businesses of changes as described in the Terms of Service. A business that no longer qualifies to use the Services will be given a reasonable period to cease the relevant activity, unless applicable law or the risk involved requires earlier action.
